Using Copyright Materials in Teaching
Use of copyright materials for personal study and non-commercial research does not extend to use of resources in teaching.
Instead you will need to use a different exception, or use material that is covered by a licence that allows use in teaching.
Illustration for Instruction
You can use the Illustration for Instruction exception to add copyright material to lectures, presentations and videos as part of your teaching. This includes use of extracts in exams and assessment questions. The exception covers material in any format.
To use this exception all of the following must be the case:
- The material you are using is illustrating a teaching point
- The amount you are using is 'fair' in relation to the point you are illustrating
- The use does not have a financial impact on the creator (e.g. by reducing sales of textbooks)
- The original is clearly acknowledged
- The use is not commercial (this may exclude use on some CPD courses)
If the use you are planning does not meet all of these criteria, you will need to ask permission from the owner of the material, use an educational licence or find an alternative resource with a license that covers your planned use.
Educational Licences
Copyright Licensing Agency (CLA) Licence
UWS holds a CLA licence for use of resources in education. This allows material to be copied or scanned for use in teaching under specific conditions.
Copying or scanning is limited to:
- 1 article from an issue of a journal (in some cases 2 articles may be permitted)
- 2 chapters or 20% of book, whichever is greater
Not all publishers and items are covered by the licence. A copy of the material to be scanned must be owned or subscribed to by the library (not an individual staff member) at the point the scan is created.
- Scanned copies for use in Module Resource Lists or for linking to from online learning materials must be created and managed by the library service. Visit 'Scanning Services for Teaching' for details
- Print copies of copyright material for use in class teaching must be made by print services. (This is carried out by the library service for London Campus)
Newspaper Licensing Agency (NLA) Licence
The NLA licence held by UWS allows occasional copying of both the printed and online versions of national newspapers plus five regional newspapers for internal use only.
- The number of copies per item is limited to 250
- Every copy must display the notice "NLA Licensed copy. No further copies may be made except under licence."
- All photocopies should be created by Print Services so that they can be recorded and reported to the CLA
- Please contact Copyright@uws.ac.uk with details of any digital copies you have made from online versions of newspapers so that these can be reported to the CLA
Any copies made from newspapers for use in teaching, whether print or digital, must be destroyed at the end of term.
Educational Recording Agency (ERA) Licence
The ERA licence enables UWS staff and students to copy, access and use broadcast outputs of ERA's members for non-commercial purposes.
The ERA members include
- The BBC
- Channel 4
- ITV
- Channel 5
- BPI (British Phonographic Industry)
- DACS (Design and Artists Copyright Society)
- Directors UK
Access and use of recordings must be on UWS premises or closed access networks (e.g. Aula / Moodle) only.
Clickview is the video platform that UWS has subscribed to to facilitate the university's use of recordings made under the terms of the ERA Licence. If you would like to include either complete programmes or extracts from television broadcasts, you can download the broadcast on Clickview and link to the broadcast from your Aula / Moodle site. Please contact the IT Helpdesk for support with using Clickview.
